In recent years, ‘nudge’ theory has gained increasing attention for the design of population-wide health interventions. The concept of nudge puts a label on efficacious influences that preserve freedom of choice without engaging the influencees’ deliberative capacities. Given disagreements over what it takes genuinely to preserve freedom of choice, the question is whether health influences relying on automatic cognitive processes may preserve freedom of choice in a sufficiently robust sense to be serviceable for the moral evaluation of actions and policies. (...) In this article, I offer an argument to this effect, explicating preservation of freedom of choice in terms of choice-set preservation and noncontrol. I also briefly explore the healthcare contexts in which nudges may have priority over more controlling influences. (shrink)

Auch gibt es bisher nur wenige Lesarten, die Kants Philosophie der Biologie im Ganzen erschließen und versuchen, sie in die vielschichtigen historischen Kontexte der frühneuzeitlichen Naturforschung einzuordnen. Das vorliegende Buch schließt diese Lücken. Es verteidigt die Thesen, dass Kant organisierte Wesen durch drei Arten von Kräften und Gesetzen charakterisiert – durch mechanische, (...) physisch teleologische und moralteleologische Krätfe und Gesetze – deren Vereinbarkeit im Bewusstsein des Menschen, und in der Erfahrungswelt, so, wie sie dem Menschen erscheint, auf der regulativen Idee ihrer Einheit im schöpferischen, theoretisch praktischen Bewusstsein Gottes beruht. Kants Lehre von organisierten Wesen kann als Verbindung einer gemäßigten, weder animalkulistisch noch ovistisch vereinseitigten, Präformationslehre mit einer vitalistischen Spielart der Epigenesislehre verstanden werden. – Weiterführende und provokative Einsichten für eine der bewegtesten Debatten der gegenwärtigen Kantforschung. In “Nudging and Informed Consent,” ShlomoCohen (2013) attempts to address the common objection against nudges that they are autonomy-thwarting because they foster irrationality. He explicitly focuses on informed consent, which he contrasts with the policy context in which health nudges are usually discussed. I think Cohen’s rich article is a significant contribution to the nudge literature. However, I have some concerns with the way he frames and motivates his inquiry...

GPs usually care for their patients for an extended period of time, therefore, requests to not only discontinue a patient’s treatment but to assist a patient in a suicide are likely to create intensely stressful situations for physicians. However, in order to ensure the best patient care possible, the competent communication about the option of physician assisted suicide as well as the assessment of the origin and sincerity of the request are very important. This is especially true, since patients’ requests (...) for PAS can also be an indicator for unmet needs or concerns. Twenty-three qualitative semi-structured interviews were conducted to in-depth explore this multifaceted, complex topic while enabling GPs to express possible difficulties when being asked for assistance. The analysis of the gathered data shows three main themes why GPs may find it difficult to professionally communicate about PAS: concerns for their own psychological well-being, conflicting personal values or their understanding of their professional role. In the discussion part of this paper we re-assess these different themes in order to ethically discuss and analyse how potential barriers to professional communication concerning PAS could be overcome. In her target article “Shared health governance” (AJOB 11(7): 32-45, 2011) and in her book Health and Social Justice (2009), Jennifer Prah Ruger defends an original model of governance dubbed “Shared Health Governance” (SHG). This model borrows elements from many other models of governance, and one may wonder what is the secret sauce that holds together these diverse ingredients. In response, Ruger would perhaps ultimately turn to public moral norms. My comment raises some concerns about the function and content of (...) these norms in her model and their connection to her claims about shared sovereignty within SHG. (shrink)

In explaining national identity as an indicator of subjective belonging to the nation-state, researchers have examined factors such as occupational structure, economic discrimination, competition, and political recognition. However, the influence of cultural factors has often been neglected. By investigating the moderating effect of Shia and Sunni rituals on national identification, I find that the nature of rituals significantly influences the strength of national identity among subordinate ethnic groups. In Shia culture, the solidarity generated through ritual practices extends into national identity, (...) fostering the formation of a confessional supra-identity. In contrast, rituals centered on personal piety in Sunni Islam do not produce the same effect. I propose a theory of interethnic solidarity based on ritual processes. A qualitative analysis of the cases of Turkey and Iran shows that in Turkey, the absence of cross-ethnic ties forged through less intense rituals leads to weaker national identity among Sunni Kurds and higher perceived ethnic discrimination. In Iran, however, the frequent practice of interactive rituals that transcend ethnic boundaries strengthens national identity among Shia ethnic minorities and reduces perceived ethnic discrimination. This research underscores how communal, intensive rituals play a key role in explaining variations in national identification. (shrink)

This essay looks at two young English-speaking Iraqi bloggers whose internationally recognized writings describe the chaos in post-Saddam Iraq. It examines sarcasm as a mode of resistance as employed by Salam Pax, characterized by BBC Radio in 2003 as “the most famous diarist in the world,” and Riverbend, whose blog was published as a book and translated into several languages. By subjecting the colonial discourse to ridicule, they not only successfully convey the angst their people suffer, but also mock a (...) stereotypical rhetoric that haunts the Western mentality regarding the Middle East. This essay negotiates their use of sarcasm as a means of non-violent resistance. It demonstrates how, for instance, they shift from the sarcastic to the absurd to unravel the banality of the colonial mind and the conceited position of its liberating enterprises. The aim of the paper is, therefore, to shed light on the emergence of a digitalized group of subalterns who write back to the center in the wake of the American intervention to topple the Baath regime in Iraq. Pax and Riverbend distinctively succeed in subverting the colonial and hegemonic gaze by unravelling the encroaching uncertainties of war through the deployment of sarcasm to signify resistance, and by transforming the coalition forces’ theatre of war into a theatre of the absurd. In the basic model of Condorcet’s jury theorem and in the literature that follows, an odd-numbered group of voters is assumed so that the simple majority rule can be used. We show that this assumption is not necessary either in Condorcet’s basic model or in the general framework of dichotomous choice. We first apply simple majority rule to an even-numbered homogeneous fixed-size committee. We then provide a justification for using simple majority rule for an even-numbered heterogeneous fixed-size committee when the (...) competence structure of the committee members is not common knowledge. The current note clarifies why, in committees, the prior probability of a correct collective choice might be of particular significance and possibly should sometimes even be the sole appropriate basis for making the collective decision. In particular, we present sufficient conditions for the superiority of a rule based solely on the prior relative to the simple majority rule, even when the decisional skills of the committee members are assumed to be homogeneous.

The Condorcet jury theorem (CJT) is based on the assumption of homogeneous voters who imperfectly know the correct policy. We reassess the validity of the CJT when voters are homogeneous and each knows the correct decision with an average probability of more than a half.

The permanent preservation of objects in global custodianship is a captivating ideal that informs countless museums’ corporate identities and governs collection guidelines as well as politics. Recent research has challenged the alleged perpetuity of collections and collected items, revealing their coherence as fragile and dependent on historically, politically and culturally specific conditions. Duplicates offer an instructive point of entry to explore the idea of collection permanence, museum politics, and the mobility of museum objects. The history of duplicates, moreover, comprises a (...) constellation of practises, concepts and debates that can be found in various forms throughout the intertwined histories of natural-scientific, ethnographic and artistic collections. This history, however, has rarely been questioned or explored. By introducing the issue of duplicates, this paper opens up a discussion that not only connects different forms of collections, but also situates the history of collecting institutions across the disciplinary spectrum within broader political, economic and epistemic frameworks. Corporate Social Responsibility (CSR) has existed in name for over 70 years. It is practiced in many countries and it is studied in academia around the world. However, CSR is not a universally adopted concept as it is understood differentially despite increasing pressures for its incorporation into business practices. This lack of a clear definition is complicated by the use of ambiguous terms in the proffered definitions and disputes as to where corporate governance is best addressed by many of the (...) national bodies legislating, mandating, or recommending CSR. This article explores the definitions of CSR as published on the Internet by governments in four countries (United Kingdom (UK), France, the United States, and Canada). We look for a consensus of understanding in an attempt to propose a more universal framework to enhance international adoption and practice of CSR using the triple bottom line. Our results concur with the findings of both national and international bodies and suggest that both within and among the countries in our study there exists no clear definition of the concept of CSR. While there are some similarities, there are substantial differences that must be addressed. We present a number of proposals for a more universal framework to define CSR. (shrink)

Food security is becoming an increasingly relevant topic in the Global North, especially in urban areas. Because such areas do not always have good access to nutritionally adequate food, the question of how to supply them is an urgent priority in order to maintain a healthy population. Urban and peri-urban agriculture, as sources of local fresh food, could play an important role. Whereas some scholars do not differentiate between peri-urban and urban agriculture, seeing them as a single entity, our hypothesis (...) is that they are distinct, and that this has important consequences for food security and other issues. This has knock-on effects for food system planning and has not yet been appropriately analysed. The objectives of this study are to provide a systematic understanding of urban and peri-urban agriculture in the Global North, showing their similarities and differences, and to analyse their impact on urban food security. To this end, an extensive literature review was conducted, resulting in the identification and comparison of their spatial, ecological and socio-economic characteristics. The findings are discussed in terms of their impact on food security in relation to the four levels of the food system: food production, processing, distribution and consumption. The results show that urban and peri-urban agriculture in the Global North indeed differ in most of their characteristics and consequently also in their ability to meet the food needs of urban inhabitants. While urban agriculture still meets food needs mainly at the household level, peri-urban agriculture can provide larger quantities and has broader distribution pathways, giving it a separate status in terms of food security. Nevertheless, both possess (unused) potential, making them valuable for urban food planning, and both face similar threats regarding urbanisation pressures, necessitating adequate planning measures. The antinomy of teleological judgment is one of the most controversial passages of Kant’s "Critique of the Power of Judgment". Having developed the idea of an explanation of organized beings by mechanical and teleological natural laws in §§ 61-68, in §§ 69-78 Kant raises the question of whether higher order mechanical and teleological natural laws, which unify the particular empirical laws of organized beings, might pose an antinomy of conflicting principles within the power of judgment. I will argue against alternative (...) views that this antinomy is neither a conflict between objective constitutive principles of the determining power of judgment nor a conflict between an objective constitutive principle of the determining power of judgment and a subjective regulative maxim of the reflecting power of judgment nor does it consist in a confusion of a pair of subjective regulative maxims of the reflecting power of judgment with a pair of objective constitutive principles of the determining power of judgment, but does consist in an apparent conflict between mechanical and teleological natural laws as subjective regulative maxims of the reflecting power of judgment. I will further argue that Kant’s resolution of the antinomy consists in the regulative idea of a supersensible that represents the unity of both kinds of natural laws and justifies the unification of both kinds of natural laws in the human power of judgment. Kant uses three notions when he talks about the supersensible – the regulative idea of a divine artisan, the regulative idea of a divine intuitive understanding, and the regulative idea of an underdetermined, supernatural ground of nature. I will show how each of these notions accounts for the unity of both kinds of natural laws and will discuss possible correlations between them. I will then explain how the unity of both kinds of natural laws in the regulative idea of a supersensible accounts for the unification of both kinds of natural laws in the human power of judgment. While the divine intuitive understanding is perfect and uncreated and, thus, capable of a representation of the unity of both kinds of natural laws, the human discursive understanding is imperfect and created; it is capable only of the representation of the unification of both kinds of natural laws in form of a hierarchy of laws. A commentary on Sections XII–XVI of the “Introduction to the Doctrine of Virtue”.

Committee decision making is examined in this study focusing on the role assigned to the committee members. In particular, we are concerned about the comparison between committee performance under specialization and non-specialization of the decision makers. Specialization (in the context of project or public policy selection) means that the decision of each committee member is based on a narrow area, which typically results in the acquirement and use of relatively high expertise in that area. When the committee members’ expertise is (...) already determined, specialization only means that the decision of each committee member is based solely on his/her relatively high expertise area. This form of specialization is potentially inferior relative to non-specialization under which the decision of each committee member is based on different areas, not just his/her relatively high expertise area. Given that the expertise of the committee members is already determined but unknown, our analysis focuses on non-specializing individuals whose decision is based on a decision rule that does not require information on the decision-making skills. Under these realistic assumptions, non-specialization is shown to be preferable over specialization, depending on the aggregation rule applied by the committee. The significance of our approach is not limited to the specific results that we obtain. Rather, it should be viewed as a first step toward a deeper examination of the role of individual decision makers in enhancing the performance of collective decision making. (shrink)

Purpose of the article One of the approaches how to create a concept of a brand is a form of identifying association network in the mind of the consumer and creating semantic maps composed of all associations that are largely shaped by cultural values of consumers. Methodology/methods In the first phase, the author of the study was detecting the associations connected with the Mexican brand alcoholic beer Corona Extra using focus group with a sample of 15 respondents. In the second (...) phase, she analysed the data found in the context of Slovak cultural values and compared them with the results of the secondary research. Scientific objective The article highlights the importance of understanding cultural values of the target market for the management and brand communication across cultures. The main objective of the survey was to determine how the Slovak respondents perceive selected sample of global brand, to compare the findings of a secondary survey conducted at German and Spanish students, and in the final phase of the research to analyse the data found in the context of the cultural dimensions of respondents. Findings On one hand, the associations formed by consumers about Corona Extra mutually differ depending on the countries surveyed. On the other hand, they correspond to the cultural values of the nation, and thus confirm the strong influence of the cultural aspects of the brand perception. Conclusions The presented article confirms, that there will always be an open space for the extensive research in global marketing and cross-cultural differences in consumer behaviour. Exploring cultural aspects of communication of global brands will benefit not only in terms of increasing the efficiency of advertising campaigns, but also for the mutual knowledge and understanding between cultures. Assim como já ocorrera com a obra de dramaturgos europeus mais de meio século antes, nesta peça mais uma vez encena-se a crise formal do drama, na medida em que a forma se desencontra do conteúdo. Não sendo indiferentes estes pontos de vista, observam-se no próprio texto os embates entre forma dramática e conteúdo épico, ora prevalecendo uma, ora outra.

Zusammenfassung Anlässlich der Veröffentlichung des Positionspapiers ‚Inklusion und Sportwissenschaft‘ fragte die Autorin, Vizepräsidentin der dvs und Initiatorin der o. g. Publikation, bei verschiedenen sportwissenschaftlichen Standorten nach Resonanz und Umsetzung des im Papier konturierten Aufgabenbereichs ‚Ausbildung‘. Dabei entstand der Eindruck, dass sich der Umgang mit dem Thema „Inklusion“ in den letzten Jahren offensichtlich verändert hat. Ging es vor einigen Jahren in den akademisch geprägten Diskussionen noch primär um die Auslegung von Inklusion und um das Pro und Contra der geforderten gesellschaftlichen und (...) bildungspolitischen Veränderungen, so deutet sich derzeit eine pragmatische Betriebsamkeit an. Inklusion erhält insofern Einzug in den Alltag sportwissenschaftlicher Ausbildung, als einschlägige Begriffe in Modulverzeichnisse eingespeist werden, Seminarpläne das Thema Inklusion punktuell aufgreifen und gezielte Oberflächenanpassungen vorgenommen werden. Strukturelle Änderungen bleiben jedoch weitgehend aus. Dieser Eindruck korrespondiert u. a. mit ministeriellen Erlassen und universitären Auflagen, die durch einschlägige Formulierungen oder Auslassungen anzeigen: Fürchtet Euch nicht vor Inklusion. ZusammenfassungIm 18. Jahrhundert kommt ein historisch neuer Typus des Festes auf: das Bundesfest als Gründungsakt. Im Zuge der Dekorporierung wird das Fest zum Medium bürgerlicher Assoziation, die allmählich auf das Politische ausgreift. Im Kontext der Verzeitlichung im 18. Jahrhundert entbindet sich das Fest seiner vormaligen Funktion zyklischer Zeitreproduktion und bildet eine futurisch-utopische Form aus. Dabei avanciert der Eid, der entinstitutionalisiert wird und als universales Kohäsionsritual Verbreitung findet, zum zentralen Element einer Dramaturgie feierlicher Kommunion, in der das Fest als epochaler ›Übergangsritus‹ (...) den Zeitenumbruch zu imaginieren und zu forcieren sucht. Von der Ebene bürgerlicher Sozialbeziehungen steigt dieser neue Festtypus mit der Französischen Revolution auf die Ebene politischer Repräsentation auf.In the 18th century a new type of feasts evolve: the covenant festival as a founding act. As the corporative society dissolves, the bourgeoisie uses festivals as an instrument of social cohesion. Those associations gradually promote a political claim. Since modern society develops linear and progressive time patterns, the festivals lose the task of cyclically reproducing time. Instead, the new utopian festivals seek to imagine and to push the turn towards a new age. They therefore fulfill the function of modern ›rites of passage‹. Being detached from institutions and becoming a ritual of universal social cohesion, the oath becomes the crucial element of the festivals’ dramaturgy seeking social fusion. From the social sphere, the bourgeois covenant festivals rise to the level of political representation in the French Revolution. (shrink)

A middle-aged Swiss friend tells me that, for her, God is ‘a contaminated word, … loaded with the spirit of many hundreds of years and miles of library shelves, a word that has nothing to do with the holistic worldview she embraces today.’1 So, she says, she has simply ‘removed the word from her vocabulary’: It’s out, it’s past, it has become a word that is used by other people only. The mindset that is expressed in these words is typical (...) for the situation in contemporary Western Europe. Many feel alienated from the notions and lifestyles and have left the institutions – churches, synagogues, mosques – that traditionally represent what we call ‘religion’. Besides, there are, in this part of the world, so many alternatives that allow one to form a meaning of life and provide security, togetherness and entertainment: family brunches on Sunday morning, TV movies, festivals, excursions, concerts, meditation workshops, neopaganist or atheist meetings, political engagements, lonely walks in the woods…. Will we, by 2050, be able to feed a rapidly growing population with healthy and sustainably grown food in a world threatened by systemic environmental crises? There are too many uncertainties for us to predict the long-term evolution of the global agri-food system, but we can explore a wide range of futures to inform policymaking and public debate on the future of food. This is typically done by creating scenarios and quantifying them with computer simulation models to get numerical estimates (...) of how different aspects of the global agri-food system might evolve under different hypotheses. Among the many scenarios produced over the last twenty years, one would expect to see the future advocated by the food sovereignty movement, which claims to represent roughly two hundred million self-described “peasants” worldwide. This movement defends a vision of the future based on relocalized, sustainable, and just agri-food systems, self-governed through direct and participatory democratic processes. Yet, food sovereignty is conspicuously absent from quantified scenarios of global food futures. As part of the roundtable, “Ethics and the Future of the Global Food System,” this essay identifies seven obstacles that undermine the creation of food sovereignty scenarios by examining two attempts at crafting such scenarios. There is growing interest in using non-coercive interventions to promote and protect public health, in particular "health nudges." Behavioral economist Richard Thaler and law scholar Cass Sunstein coined the term nudge to designate influences that steer individuals in a predetermined direction by activating their automatic cognitive processes, while preserving their freedom of choice. Proponents of nudges argue that public and private institutions are entitled to use health-promoting nudges because nudges do not close off any options. Opponents reply that the nudgee (...) has no opportunity to deliberate over her choice. The nudger controls the nudgee, who has no real freedom of choice. -/- In my dissertation, I salvage the concept of nudge from the charge that it merely pays lip service to freedom of choice, offer an alternative account of the moral import of nudges for the evaluation of public health policies, and provide an ethical framework for their justified use. -/- My argument proceeds in four steps. First, I argue that nudging mechanisms often involve some form of incomplete deliberation, and do not always bypass deliberation. Second, I maintain that nudges preserve freedom of choice because they preserve the choice-set and are substantially noncontrolling. I show that the debate over nudges is plagued by confusion between real nudges, which are easily resistible and therefore substantially noncontrolling, and influences that are not easily resistible yet activate the same cognitive mechanisms as nudges. Third, I reject the view that nudges are systematically preferable to more controlling influences, even when they interfere with non-consequential liberties. I show that the principle of the least restrictive alternative often invoked in public health ethics is applied with too wide a scope. Fourth, I argue that paternalism is not central to the ethics of public health nudges. Rather, the substantive problem with nudges is that their overall cumulative effect might weaken our decisional capacities or undermine their proper exercise. This is a reason to limit recourse to certain nudges. I finally show, contra certain Kantians and Millians, that we have no perfect duty to engage or enhance decisional capacities. (shrink)
